For those of you who don't know Mobility International is an Organization based out of Eugene, OR in addition to running this exchange program for youth with disabilities in the 5 Boroughs (including non-students) and many others for People with Disabilities the world over they run the National Clearing House On Disability (click here). Which (straight from their website) is a "comprehensive one stop resource on advising and tools for PWDs,... on increasing disability inclusion in international study, volunteer, teach and other exchange programs"

Affordable Care Act Supports States in Strengthening Community Living

Nationally, $4.3 Billion in New Funds Announced to Help Establish and Expand Community-based Alternatives to Institutional Long Term Care

States will see significant new federal support in their efforts to help move Medicaid beneficiaries out of institutions and into their own homes or other community settings now and in the near future, Health and Human Services (HHS) Secretary Kathleen Sebelius announced today.

The Affordable Care Act provides additional funding for two programs supporting that goal, the Money Follows the Person (MFP) demonstration program and the Community First Choice Option program. Today, Secretary Sebelius announced thirteen States would together receive more than $45 million in MFP grants to start that program in their States, with a total of $621 million committed through 2016. In addition, HHS has proposed rules to allow all States to access a potential of $3.7 billion in increased federal funding to provide long-term services and supports through the Community First Choice Option program.

Thirteen States Receive Money Follows the Person Program Grants

The Money Follows the Person (MFP) demonstration program, which was set to expire in fiscal year 2011, is extended through the Affordable Care Act for an additional five years. The 13 States receiving awards today (see list and award amounts below) join the 29 States and the District of Columbia already operating MFP programs. Together, these States will receive more than $45 million in the first year of the program, and more than $621 million through 2016.

The MFP program provides individuals living in a nursing home or other institution new opportunities to live in the community with the services and supports they need. Groups benefiting from these home-and-community based programs include the elderly, persons with intellectual, developmental and/or physical disabilities, mental illness or those diagnosed with several of these conditions. To date, these programs have helped 12,000 individuals move out of institutions and back into their communities. Todayb s grants are expected to help an additional 13,000 people.

b The Money Follows the Person program is hugely important to improving the lives of Medicaid beneficiaries,b said Donald Berwick, M.D., administrator of the Centers for Medicare & Medicaid Services (CMS), which will implement the demonstration program. b This helps bring everyone, even those who in the past may have had no choice but to live in an institution, into the community where they can become full participants in the activities most of us take for granted.b

New Community First Choice Option Available to States

Many of the same goals under the MFP demonstration are shared and supported by the Community First Choice (CFC) Option, created by the Affordable Care Act. Today, nursing homes and institutions are too often the first or only choice for people with Medicaid who need long term care. The goal of this new option is to give States additional resources to make community living a first choice, and leave nursing homes and institutions as a fall back option.

Starting in October, this option will allow States to receive a six percent increase in federal matching funds for providing community-based attendant services and supports to people with Medicaid. Over the next three yearsb through 2014b States could see a total of $3.7 billion in new funds to provide these services. States currently receive Federal Medicaid matching funds for these activities at the Stateb s normal matching rate.

Services and supports that can be provided under CFC include, but are not limited to, attendant services and supports that help individuals with activities of daily living such as bathing and eating, and health-related tasks through hands-on assistance or supervision. States may also cover costs related to moving individuals from an institution to the community, such as security and utility deposits, first monthb s rent, and purchasing basic household supplies.

To qualify for the increased Federal funds, States must develop b person-centered plansb that allow the individual to determine how services are provided to achieve or maintain independence. States must also establish implementation councils with a majority membership consisting of persons with disabilities, elderly individuals and their representatives to advise in the design and implementation of Community First Choice option. The proposed rule, posted today, describes the details of this program and solicits public comment. The rule can be found at: http://www.ofr.gov/OFRUpload/OFRData/2011-03946_PI.pdf.

Over $2.2 Million to Resolve Fair Housing

Accessibility Case in Manhattan



In 2006, the Fair Housing Justice Center, Inc. (FHJC) conducted a testing investigation to

determine whether new multi-family rental developments in Manhattan were being designed and

constructed in compliance with the accessibility requirements of the federal Fair Housing Act

(FHA). The FHJC investigation, funded by the U.S. Department of Housing and Urban

Development (HUD), found non-compliance with the design and construction provisions of the

FHA. The testing identified barriers which posed significant challenges to people with disabilities

who use wheelchairs. The FHJC forwarded the results of its testing, including information about

Avalon Chrystie Place apartments, to the United States Attorney’s Office for the Southern District

of New York (U.S. Attorney’s Office). In 2008, the U.S. Attorney’s Office filed a lawsuit which

alleged that developers and architects of Avalon Chrystie Place and six other Avalon Bay

Communities in New York City had failed to design and construct their buildings in compliance

with the accessibility requirements of the FHA.



Yesterday, the U.S. Attorney’s Office announced a resolution to the lawsuit. The consent

decree covers 2,557 Avalon apartment units and provides:



1). $2,045,600

to compensate victims (i.e., any person who was harmed by the lack of

accessible features, discouraged from living in the apartments because of the lack of

accessible features, who personally paid to make an apartment accessible to persons with

disabilities, or who was otherwise discriminated against on the basis of disability based on

the design and construction property and apartment flaws);



2).

a civil penalty of $90,000; and,



3).

an Accessibility Project Fund of $72,000 to increase the accessibility of apartment

kitchens

.



Altogether, the settlement is worth over $2.2 million and specifically requires that the relevant

apartments and common areas be retrofitted so people with disabilities can access, use and enjoy

these rental housing opportunities.

The mission of the FHJC is to challenge systemic housing discrimination, promote open and

investigative assistance (including testing), and referrals to administrative agencies and cooperating

ICD-International Center for the Disabled and its Client Advisory Board announce the opening of Expression Through Art, an art exhibit created by clients of ICD in celebration of ICD’s 90th Anniversary. Expression Through Art features the work of artists of diverse backgrounds and reflects their varied life experiences. Some of the exhibited artists were creating art prior to the onset of disability and others found art as a result of their disability.



The show is open to the public at ICD, 340 E24th Street, 2nd floor, between 1st and 2nd Avenues in Manhattan, Monday to Friday from 8am-1pm, and will run until June. For more information call 212-585-6070.



ICD offers outpatient rehabilitation services, including a mental health clinic, brain injury services, addiction recovery services, physical medicine, and rehabilitation, physical and occupational therapy, and primary medical care.

Vocational Rehabilitation in Employment Update: Self-Employment as a Customized Employment Outcome

Some people with disabilities will consider self-employment as a career option due to a lack of available employment opportunities in the community. However, difficulty finding a job should not be the only reason that a person decides to start a business. Mental Health Parity Bill: Finally on the Way to Becoming Law

For the past 15 years, the Mental Health Parity Bill, guaranteeing that
mental health disabilities receive the same medical insurance coverage as
any other health problem, has languished in Congress. Recently, however,
the Mental Health Parity Bill was put on the fast track to passage in the
new Congress. It is expected that the Bill will be signed early this year.

New website that brings together employers and people with disabilities
seeking employment

Windows Vista Offers Greater Accessibility
Vista, the new Microsoft operating system, includes a variety of new
features and functions that enhance accessibility. The new Ease of Access
Center in Vista is where users can set up the accessibility features that
are beneficial to them, such as the new speech recognition feature which
allows users to interact with their computer by voice.

100M boost opens doors to Section 8

For the first time in more than a decade, the city will be accepting new applications for Section 8 vouchers - with 22,000 families getting the coveted housing subsidy."This really is a very big deal in the housing business," Mayor Bloomberg said yesterday at an applications office in Corona, Queens.

A huge boost in federal funding - up to $100 million nationwide - is behind the largess that's opening up the waiting list for the first time since 1994.

Applications will be accepted for three months starting Feb. 12.

Officials said 12,000 vouchers will be available this year and an additional 10,000 next year. The city will set aside 3,000 for households at risk of becoming homeless.

With a Section 8 voucher, families pay 30% of their income for rent, and the New York City Housing Authority, the largest provider of public housing in the country, pays the remainder directly to the landlord.

The current waiting list has 127,000 families - but time has rendered most of the names obsolete. Of the 75,000 people the city already has contacted, about 60,000 no longer want the vouchers, are no longer eligible or can't be found.

Janet Perry, 48, who has been living in a Brooklyn homeless shelter for nearly a year, was elated to hear she might be in line to get her own apartment.

"I'm very happy," said Perry, a former groundskeeper for the city's Parks Department.

"I called already and the line's been busy, busy, busy at the Section 8 office," Perry said. "I'm going to keep calling, though, until I get someone."

Mary Brosnahan Sullivan, executive director of the Coalition for the Homeless, said she's concerned these vouchers won't reach those with the "most urgent need."

Over the years, the Bloomberg administration has steered homeless people away from Section 8 and toward the "highly flawed" Housing Stability Plus program, which makes it difficult for families to get permanent housing, she said.

But Bloomberg spokesman Jason Post said under the mayor's administration, far more New Yorkers receive rental assistance than before.

"We want to ensure as many households as possible - homeless or otherwise - can benefit," Post said.



First steps toward housing subsidy

Here's how to apply:


Applicants can pick up forms at any of the New York City Housing Authority's borough applications offices or management offices. For a list of addresses, go to www.nyc.gov/nycha or call 311.




Individuals who earn less than $24,800 a year or a family of four making less than $35,000 a year may qualify for the subsidy.


Applications must be postmarked no later than May 14.
